TERMS AND CONDITIONS
Your use of, and/or access to the SMS/Text Message Voting services constitutes your agreement to the Terms and Conditions. Carolina Music Awards / CMA Big Break & CEE Mobile reserve the right to amend the Terms and Conditions at any time. a) You can vote as many times as you like b) You can vote by sending an SMS/Text Message. c) SMS cost $0.99 including GST each d) If you are not the bill payer you should seek the permission of the person responsible for paying the phone bill before voting e) You must ensure that all care is taken when sending text messages to the SMS/text message numbers. It is your responsibility to send the correct message. Carolina Music Awards, CMA Big Break and the Voting Service Providers will not be liable for costs incurred, responses received or any other consequences of user error. f) You acknowledge that if you text outside the voting hours your vote will not be registered but, because of the response software used, you will still be charged 99 cents e) The charges for all SMS/Text Message Voting services will appear on your telephone or mobile bill. All queries in relation to billing should be directed to your telephone or mobile carrier f) CMA's reserves the right to extend, postpone, or cancel a vote and to update these terms and conditions on www.carolinamusicawards.com & www.cmabigbreak.com without notice g) CMA's reserves the right to change the broadcast or voting times without notice h) No responsibility will be accepted for non-receipt for any reason of a text message vote i) Standard network charges may apply j) Response times for SMS return messages may vary and are subject to network coverage and availability, alert volumes, the memory of the SIM card inside your mobile phone not being full and/or any technical problems. k) All SMS responses are deemed to be received at the time of receipt into the CMA's database, NOT at the time of transmission by the viewer l) The eventual delivery of SMS/Text Messages to CMA's / CMA Big Break is largely dependent on additional parties and the effective functioning of the sender's mobile operator's systems and infrastructure. Consequently, CMA, CMA Partners and the Voting Service Providers will not be liable for non-receipt of, or late receipt of, messages due to issues resulting from services provided by the participant's mobile providers. Should there be a dispute, CMA's shall endeavor to make the necessary investigations to the best of its abilities and attempt to rectify the discrepancy, but should such investigations prove to be inconclusive, no further action can be taken against CMA, CMA Partners or Voting Service Providers by CMA's voters m) All SMS/text votes received by the CMA / CMA Big Break database will receive a reply confirmation message. In times of high entry volumes some delays may occur in the delivery of this reply message. CMA's will do its best to ensure all confirmation text messages sent to you are delivered promptly. Successful delivery depends on additional parties such as telecommunication network suppliers and ISP's, hence CMA's cannot guarantee that messages will arrive promptly or arrive at all. Message delivery performance is subject to the recipient's mobile terminal being switched on and located within an area that is acceptably covered by the recipient's service provider. Furthermore, mobile operators can prevent their subscribers from receiving SMS messages, for whatever reasons, and in such cases message delivery is not possible. CMA, CMA Partners and Voting Service Providers will not be held responsible for any loss, damages or injury whatsoever arising from the receipt or non-receipt of text messages n)Under no circumstances are CMA's, CMA Partners or Voting Service Providers liable for any indirect/special and/or consequential damages or loss whatsoever which result from any use or access to or any inability to use or access the SMS/Text Message Voting service. o)CMA's, CMA Partners and Voting Service Providers make no guarantee that SMS/Text Voting services will be available, uninterrupted, free from error or delay or that any such error or delay will be corrected. COMPLAINTS & QUERIES Any queries relating to SMS/Text Messaging entries should be addressed with your service provider in the first instance.
